GrayRobinson Labor and Employment Insight: UPDATE - Florida’s CHOICE Act Becomes Law

The Florida Contracts Honoring Opportunity, Investment, Confidentiality, and Economic Growth Act (HB 1219, the CHOICE Act) is now law.  Presented to Governor Ron DeSantis on June 18, 2025, the CHOICE Act became law following the running of the Governor’s review period on July 3, 2025. 

To be codified at §§ 542.41 through 542.45, Florida Statutes, with an effective date of July 1, 2025, the CHOICE Act marks a pro-employer recalibration of Florida’s restrictive-covenant regime – expanding employer options for implementing valid restraints of trade or commerce, including noncompetes. 

The CHOICE Act does not replace Florida’s prior statute governing the use of restrictive covenants, § 542.335, Florida Statutes, which remains an effective tool for protecting the legitimate business interests of employers.
