On March 5, 2024, Federal Communications Commission (FCC) Chairwoman Jessica Rosenworcel issued a press release indicating she was proposing that the FCC ban bulk contracts for broadband and video services (satellite and cable) in multi-dwelling unit (MDU) properties (such as condos, HOAs, apartments, mobile home parks, etc.).
A bulk contract is where the provider bills the MDU owner, whether a condo association or apartment property owner, and services all property units, usually at “bulk” rates typically discounted from standard retail rates. Chairwoman Rosenworcel’s proposal aims to lower costs and create consumer choice in such MDUs. With millions of MDUs in Florida alone, this could impact innumerable contracts in the state and across the country.
The chairwoman’s announcement follows a release by the White House that same day mentioning this as part of President Joe Biden’s plan to assist consumers. If the FCC decides to move forward, it will issue a Notice of Proposed Rulemaking (NPRM), which would allow for comments before adopting rules. Specific details about the proposed rules are not yet available.
