GrayRobinson Bankruptcy Deputy Section Chair Luis Rivera participated in a panel discussion on "MCA Lenders in Bankruptcy - Is it the Wild West or a New Frontier?" for the Business Law Section of The Florida Bar. The program provided an overview of the history of MCA lending and the issues implicated in how to characterize a merchant cash advance. Luis' presentation discussed a case law update on how courts across the country are treating these financing arrangement, i.e., whether as a true sale or a disguised loan.
In addition to the Bankruptcy deputy section chair, Luis serves as the Fort Myers and Naples deputy managing shareholder. He helps clients navigate some of the most difficult situations faced by businesses, including complex business litigation, bankruptcy, creditors' rights, and insolvency matters. A trusted advisor, Luis is one of only 10 attorneys in Florida who is board-certified in Business Bankruptcy Law and Consumer Bankruptcy by the American Board of Certification and one of only two court-appointed fiduciaries who administers Chapter 7 bankruptcy cases in Southwest Florida.
