Notable Work
- Represented the Chapter 7 trustee in complex bankruptcy litigation involving multiple merchant cash advance companies. Successfully prosecuted civil RICO, fraudulent transfer, and related claims resulting in court-approved settlements returning millions of dollars to the bankruptcy estate.
- Represented a physician and the physician's medical practice in related Chapter 11, Subchapter V bankruptcy cases after they were induced to purchase medical equipment financed through approximately $1 million in loans. Successfully objected to the equipment lenders' claims, enabling both clients to confirm their Chapter 11 plans of reorganization and ultimately receive their bankruptcy discharges.
- Successfully reorganized a dental practice through a Chapter 11, Subchapter V bankruptcy following a COVID-19-related downturn in business. Confirmed a Chapter 11 plan restructuring substantial debt, including merchant cash advances, enabling the practice to continue operations and positioning the owner to successfully sell the practice following completion of the reorganization.
- Represented the Chapter 7 trustee of a clinical research company conducting pharmaceutical trials for many of the world's largest pharmaceutical companies. Negotiated agreements preserving critical research records, preventing substantial financial losses, and avoiding delays in pharmaceutical research and development.
- Represented the City of New York in a published appeal before the U.S. Court of Appeals for the 11th Circuit involving complex bankruptcy, jurisdictional, environmental, and property tax issues.
- Represented the victim of a Ponzi scheme whose financial advisor committed suicide following the collapse of the scheme. Negotiated a settlement with the financial advisor's estate that recovered the client's life savings and her children's college funds.
- Represented a debtor with approximately $1.3 million in debt secured by four underwater investment properties and approximately $785,000 in unsecured debt, obtaining a discharge of all debt without payment to the bankruptcy estate.
