Scott Cagan and Robert Weill Mentioned in Law360

FORT LAUDERDALE, FL. - March 4, 2020 - Scott L. Cagan and Robert Weill, shareholder and of counsel, respectively, in GrayRobinson's Fort Lauderdale law firm office, were mentioned in the Law360 article "11th Circ. Upholds $2M Award In Fla. Advocates' Solar Spat," The article discusses how the Eleventh Circuit upheld a $2 million arbitration award in favor of two groups that had pushed for a solar energy ballot initiative in Florida in 2015. The appeals court rejected appellant PCI Consultants, Inc.’s contention that the award should be vacated.

PCI was hired by Floridians for Solar Choice Inc. and Southern Alliance for Clean Energy Inc. in 2015 to collect signatures for an effort to add a solar energy amendment to the state's constitution. PCI sued the solar groups for around $212,000 for allegedly unpaid expenses, and refused to release 217,000 signed petitions. The solar groups disputed PCI’s claim and asserted counterclaims. The arbitrator ruled in favor of the solar groups and against PCI. The arbitrator’s award of approximately $2 million, which included an award of attorneys’ fees, was then confirmed by the United States District Court for the Southern District of Florida.

The article notes that the solar groups were represented by Weill and Cagan. Cagan was also co-counsel for the solar groups at the arbitration hearing and in the district court proceedings. Read the article here. (subscription required)
