GrayRobinson Shareholder Gregory Hearing today presented “Controversial Speech in the Workplace: What to Do in These Turbulent Times?” at the Florida City and County Management Association (FCCMA) Annual Conference on Thursday, June 1, 2023, at the Hyatt Regency Grand Cypress Resort in Orlando, Fla. The presentation detailed employee misconceptions about the exercise of free speech in the workplace, further reviewing the extent to which public employee speech is or is not protected by the First Amendment or under other legal authorities, as well as a public employer’s right to discipline employees when they engage in speech that crosses the threshold into unprotected speech.
