By: William H. Andrews, Of Counsel

On January 1, 2021, Florida’s minimum wage will be increased to $8.65 per hour, a $0.9 increase over the 2020 minimum wage. The minimum wage for tipped employees will be $5.63 an hour. As a result of a recently approved constitutional amendment to the Florida Constitution, the minimum wage will be raised to $10.00 an hour on September 30, 2021 and increased by $1.00 each year until reaching $15.00 an hour on September 30, 2026. On September 30, 2027, and on each following September 30th, the state Agency for Workforce Innovation shall calculate an additional minimum wage rate by increasing the current minimum wage rate by the rate of inflation during the 12 months prior to each September 1st using the consumer price index for urban wage earners and clerical workers, CPI-W, or successor index as calculated by the United States Department of Labor.
