In the analysis, Goodman discusses whether or not Florida’s employees who have signed non-compete agreements can still be bound by them if they have been laid off due to COVID-19. Goodman writes, “The fact an employee was laid off due to COVID-19 has no legal impact on the employer’s ability to enforce its non-compete agreement against its employees. In summary, there is no such thing as a ‘fairness,’ or similar, defense under Florida law.”
