Roy Kobert and Maureen Vitucci Successfully Defend Butler and Hosch

ORLANDO, FL – October 13, 2015 – Bankruptcy attorney Roy S. Kobert, shareholder in GrayRobinson’s Orlando law firm office, and attorney Maureen A. Vitucci, successfully defended Florida-based firm Butler and Hosch, P.A., who closed their doors back in May 2015. The plaintiffs in the case were former employees of the firm accusing them of violating the Worker Adjustment and Retraining Notification (WARN) Act by failing to give proper notice before the massive layoff when the firm closed. Butler and Hosch claimed the plaintiffs failed to identify the specific defendant liable under each of the five counts in the complaint, with the possible exception of counts 4 and 5. The complaint has only one prayer for relief after those five counts, and asked for entry of judgment against defendants, according to Butler and Hosch, which added that the "catchall prayer for relief" is confusing. The plaintiffs stated that counts one, two, four and five clearly state which defendant they're targeting, while count three — alleging WARN violations — references "Defendants" because its directed at Hosch and the firm. On October 8, 2015 the court agreed with Hosch’s motion to dismiss the class action complaint.
