    MIAMI, FL – April 10, 2015 – Peter Quinter, Shareholder in Charge of the Customs and International Trade Law Group at GrayRobinson, recently obtained a favorable settlement for Yavuz Cizmeci, a Turkish national residing in Istanbul, Turkey, and former President and CEO of a Turkish airline, Ankair. On June 6, 2008, Ankair was added to a Temporary Denial Order naming others, including Iran Air and Galaxy Aviation Trade Company Ltd., to prevent the re-export of a Boeing 747 aircraft to Iran. The aircraft was located in Istanbul, Turkey, as part of the fleet owned and operated by Ankair, and was in the process of being sold to a United Kingdom company. The Bureau of Industry and Security (BIS) of the U.S. Department of Commerce warned Ankair that the aircraft was really being sold to a front company for the Iranian Government. Hence, Ankair and Mr. Cizmeci were specifically identified in Temporary Denial Order issued by the U.S. Department of Commerce prohibiting the sale of and export of the Boeing 747 aircraft. As soon as the aircraft was sold, it was flown by an Iranian crew to Tehran, Iran, rather than to its expected destination for repairs in Pakistan, according to the U.S. Department of Commerce. Mr. Cizmeci, acting as Ankair's CEO, was charged by the U.S. Department of Commerce with facilitating the transfer and re-export of the Boeing 747 to Iran, in violation of the Export Administration Regulations.

    Before a Judge could issue a decision on the case, the BIS and Mr. Cizmeci agreed to to settle the charges that Mr. Cizmeci aided and abetted Ankair’s transfer of U.S.- origin aircraft to Iran Air without the required BIS authorization and in violation of a Temporary Denial Order. Mr.Cizmeci agreed to pay $50,000 in lieu of the assessed monetary penalty of $10.6 million, and his export privileges are denied for the next 20 years.
