Labor and Employment E-lert – EEOC Provides Guidance on Component 2 EEO-1 Filing Requirements via Filing System Portal

The EEOC recently released an update of its Component 2 EEO-1 Online Filing System website with information and materials regarding the requirement that employers with 100 or more employees submit pay and work hours data as part of their EEO-1 reporting. As noted in a previous update, EEO-1 filers must submit Component 2 data for calendar years 2017 and 2018, by September 30, 2019, as ordered by the District Court's recent decision in National Women's Law Center, et al., v. Office of Management and Budget, et al., Civil Action No. 17-cv-2458 (D.D.C.). Employers should note that although the foregoing decision is up on appeal, there has been no stay of the reporting requirements pending the appeal.

The filing portal for Component 2 Data opened July 15, 2019, and EEOC system login information is being sent to employers via USPS and email.  If you did not receive the system login information, you should contact the EEOC HelpDesk referenced below. We recommend that employers required to submit Component 2 Data continue to monitor the EEOC’s webpage, which can be accessed through this link.

Further, in light of this new reporting obligation, the EEOC has opened an employer HelpDesk to offer support related to Component 2 filings. The contact information for the HelpDesk is as follows:
