Melbourne Attorneys Secure Victory in Life Insurance Policy Lawsuit

MELBOURNE, FL – December 12, 2017 – Attorneys Alec D. Russell and Tiffany M. Walters prevailed at trial in a lawsuit over the proceeds of a one-million-dollar life insurance policy. The decedent, who was previously married to the client for over twenty years, was obligated under the final judgment of dissolution of marriage to maintain the life insurance policy for the client’s benefit. Prior to his death, he changed the beneficiary of the policy to his new wife. The client filed suit against the decedent’s wife for the policy proceeds on the theory that she was the equitable owner of the policy. After trial, the Court found that the decedent’s attempt to change the beneficiary was legally ineffective and awarded the client the entire policy, plus the interest that had accrued, which totaled more than $1,188,000.
