GR Attorneys Secure Victory in Public Records Case

ORLANDO, FL – November 20, 2015 – Attorney Thomas A. Cloud, attorney Rachael M. Crews, both shareholders in GrayRobinson's Orlando law firm office, and attorney Monterey Campbell, of counsel in GrayRobinson's Lakeland law firm office, secured a victory on behalf of Polk City in a public records request case. This was a case of first impression concerning the meaning of Section 119.0701, Fla. Stat., which requires local governments to include public records enforcement language in certain contracts with the private sector, and involved an allegation that the City failed to include necessary language in a solid waste franchise agreement. The plaintiff, Joel Chandler, filed separate suits against 30 other entities in Polk County in the same month he filed suit against Polk City. The Court rejected Chandler’s claims and dismissed the entire lawsuit against the City. The order can be viewed here.
