Biography

Ty focuses his practice on administrative and regulatory law, including litigation arising in those areas. He represents healthcare entities and individuals, including physicians, hospitals, special hospital districts, health plans, blood banks, clinical laboratories, pharmacies, pharmacy benefit management companies, pharmaceutical manufacturers, repackagers or distributors, third party administrators, governmental entities, vendors, and corporations in a broad range of administrative, complex civil litigation and consulting matters.  He has experience representing clients before agency boards, at administrative hearings, in state and federal courts and before Florida’s legislative and executive branches of government.

Ty also provides representation to design professionals, owners, and contractors in construction litigation and licensing matters, banking and financial institutions, prepaid education organizations, outdoor advertising companies, and petroleum marketers involving franchising, pollution cleanup and environmental compliance, fair marketing and state and local taxation.

Regulatory & Administrative Law

Ty represents clients relating to regulatory compliance issues before Florida's Agency for Health Care Administration, Department of Health, Department of Education, Department of Transportation, Department of Environmental Protection, Department of Business and Professional Regulation, Office of Insurance Regulation, Department of Financial Services, Department of Revenue, Agency for Persons with Disabilities and Department of Children and Families.  His representation of clients on regulatory issues includes litigation concerning those matters before state regulatory boards, the Florida Commission on Ethics, and at the Division of Administrative Hearings.  He has tried a number of certificate of need matters, procurement protests, and challenges to proposed, adopted, and unadopted rules, and has defended numerous clients against licensure denials and disciplinary proceedings brought by various state agencies and departments.

Ty also advises many public and private clients on Florida’s Public Records Act and Sunshine Law.

Representative Matters

  • Successfully defended a public hospital client’s award of certificates of need for pediatric and adult kidney transplant programs against a challenge by a competitor hospital seeking to establish similar programs.
  • Obtained a final order on behalf of a public hospital client denying a competitor facility’s attempt to obtain a certificate of need to establish a comprehensive medical rehabilitation facility.
  • Successfully defended a health care plan against alleged overpayment claims under the Medicaid program brought by the Florida Agency for Health Care Administration.
  • Obtained a finding of no probable cause before the Florida Commission on Ethics on behalf of a client who was accused of accepting improper funds for lobbying.
  • Defended a construction contractor against an administrative complaint brought by the Department of Business and Professional Regulation, obtaining a recommended order at the Division of Administrative Hearings that resulted in entry of a final order that reduced the fine sought against the contractor by almost 70%.
  • Ongoing representation of health care related entities, including pharmacies, pharmacy benefit management companies, and third party administrators, among others, concerning licensing and regulatory compliance issues.
  • Ongoing representation of pharmaceutical manufacturers, repackagers and distributors concerning compliance with Florida law regulating the manufacturing and distribution of over-the-counter and prescription drugs.
     
Complex Litigation

Ty represents both governmental and private clients at trial and in arbitration proceedings involving complex legal claims. 

Representative Matters

  • Obtained partial summary judgment on behalf of health care client in a nine-year-old qui tam action originally brought by a competitor health care institution, and pursued by Florida’s Attorney General’s Office on behalf of the State of Florida.
  • Obtained favorable outcomes in numerous complex foreclosure cases on behalf of financial institution clients, including successful defense of claims and counterclaims alleging violations of the Florida Deceptive and Unfair Trade Practice Act and Florida Consumer Collection Practices Act.
  • Ongoing representation of a health plan seeking recoupment of millions of dollars owed under a health care contract with the State of Florida.
Government Affairs

Ty represents a range of clients, including in the areas of health care, the construction industry and the defense sector, among others, before the legislative and executive branches of Florida’s government. He helps his clients understand the legal implications of legislative issues affecting them, and advocates for changes that will positively impact his clients and their industries.
