Gary Resnick Featured in Law360

FORT LAUDERDALE, FL – October 29, 2018 – Attorney Gary I. Resnick, shareholder in the Fort Lauderdale office, and Chair of the Communications/Cable/Broadband practice group, was featured in the Law360 article "FCC’s 5G Regs Deepen Old Divide For Some States, Cities." The article discusses state and Federal preemption of local governments on issues regarding deployment of communications infrastructure and net neutrality.

Resnick shared his concerns around the Federal Communications Commission (FCC) adopting an Order that did not take into sufficient consideration significant concerns of local governments, including taxpayer subsidies to the industry, public safety, aesthetics, providing advanced services to low income areas and other issues with preempting local control of deploying these facilities in public rights-of-way. He also explains that "the states and local governments that pushed back on [the] net neutrality change are the ones where the industry doesn’t always necessarily get what it wants, and the same can be said for the small-cell [infrastructure]."
